Va. gives agents teeth on false certificate of insurance requests

Written by Kathryn Flores on March 24, 2012 – 2:25 pm

Virginia Gov. Bob McDonnell signed into a law a bill enabling the state insurance regulators to fight false certificates of insurance and those who request them.

The law, which takes effect July 1, defines and clarifies what a certificate is; prohibits any person from issuing or demanding the issuance of a certificate that includes false or misleading information; affirms that certificates are not insurance policies and cannot be used to alter, revise, or modify and insurance policy; and most importantly, authorizes the Bureau of Insurance to enforce the act.

Over the past few years, the Independent Insurance Agents of Virginia (IIAV) has received hundreds of calls from agents asked to falsify certificates of insurance under threat of clients, according to Robert N. Bradshaw Jr., the groups president and CEO.

The law, supported by other insurance trade groups, gives the Virginia State Corporation Commission Bureau of Insurance (BOI) the power to regulate issuers and requesters of false certifications of insurance for the first time.
